Terms & Conditions
These Terms govern the website and flight-claim management service provided by CLAIM PLEASE S.R.L. ("Claim Please", "we", "us"). We are an Italian limited liability company registered under number and VAT code 02474250681, with registered office at Viale della Pineta 15, 65129 Pescara (PE), Italy.
1. Scope and contract formation
You may use the free eligibility checker without appointing us. A paid service contract begins only when you accept these Terms, sign the Assignment Agreement or other authority document presented for your claim, and we accept the case. The contract and Assignment Agreement are currently available in English only. Please do not sign if you do not understand them.
2. Our service
We assess information supplied by you and available flight data, prepare and submit a monetary claim, communicate and negotiate with the airline, receive payment where permitted, and arrange your net payout. Eligibility results are preliminary estimates, not guarantees. We may accept, decline, pause or close a claim where the evidence, applicable law, economics, enforceability or prospects do not justify continuing.
Claim Please is a claim-management and technology business. It is not a law firm and does not provide reserved legal advice or represent clients in court. If legal proceedings are appropriate, we may appoint an independent, duly qualified lawyer or law firm in the relevant country.
3. Assignment and authority
By signing the Assignment Agreement, you assign to Claim Please the monetary flight claim identified in that agreement, to the extent the applicable law allows. We may then pursue, negotiate, settle and collect that claim in our own name. Where assignment is restricted or another form is required, we may ask you to sign an authority document or power of attorney instead. No court filing will be made in your personal name without any additional consent required by applicable law.
Each passenger must sign separately, except where a parent, guardian or duly authorised representative may lawfully sign for that passenger.
4. No-win, no-fee price
If no monetary compensation is recovered, our service fee is zero. If compensation is recovered, our fee is 35% of the gross compensation recovered, including any VAT applicable to our fee. The passenger receives 65%. We do not charge a separate legal-action surcharge unless you expressly accept a separate written amendment before that cost is incurred.
Compensation paid directly to you by the airline after our contract begins is still a successful recovery and the 35% fee remains due. Court-awarded legal costs, statutory interest or reimbursement of costs advanced by us may be retained by us to cover those costs unless mandatory law or a written agreement says otherwise.
5. Payments
Airlines are instructed to pay Claim Please in EUR to the appropriate SEPA or SWIFT account. After cleared funds are received and compliance, identity and payout checks are complete, we deduct our fee and transfer your 65% share without undue delay. You are responsible for providing accurate beneficiary details. Intermediary or beneficiary-bank charges and currency conversion outside our control may reduce the amount credited to a non-EUR account.
6. Your responsibilities
- Provide complete, accurate and non-misleading information and genuine documents.
- Have authority to submit data and sign for every passenger you represent.
- Tell us about any earlier claim, assignment, settlement, voucher or payment.
- Do not pursue, assign or settle the same claim elsewhere while we own or manage it.
- Forward airline communications and direct payments to us promptly.
- Cooperate with reasonable evidence, identity and signature requests.
7. Settlements and legal action
We may make routine procedural decisions and reject non-monetary vouchers. We will not accept a settlement materially below the assessed statutory amount without informing you, unless we own the claim outright and the signed Assignment Agreement expressly permits that decision. Legal action is handled only by qualified counsel. We will explain any material personal cost or adverse-cost risk and obtain any consent required before proceeding.
8. Withdrawal and termination
If you are an EU/EEA consumer, you may withdraw within 14 calendar days after the service contract is concluded, without giving a reason, by emailing support@claimplease.com. If you expressly ask us to begin during that period and then withdraw before completion, mandatory law may allow us to charge a proportionate amount for work already performed. Once the service has been fully performed after your express request and acknowledgement, the statutory withdrawal right may end.
After the statutory withdrawal period, termination requires our written confirmation and, where the claim was assigned, a written reassignment. Accrued fees remain payable if compensation has already been obtained, offered, confirmed or paid as a result of our work. We may terminate for fraud, material breach, non-cooperation, duplicate representation or where continued pursuit is unlawful or unreasonable.
9. Liability
We do not guarantee recovery, timing or any particular decision by an airline, authority or court. Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud, wilful misconduct, gross negligence, death or personal injury where applicable, or mandatory consumer rights.
10. Data and communications
We process personal data as described in our Privacy Policy. Service notices may be sent by email, phone, WhatsApp or through the customer portal using the contact choices you provide. Marketing is optional and separate from service communications.
11. Governing law and disputes
These Terms are governed by Italian law. This choice does not deprive a consumer of mandatory protections or the right to bring proceedings in a court that has jurisdiction under applicable consumer law. Please first contact support@claimplease.com so we can try to resolve a complaint.
12. General
We may update these Terms prospectively. Material changes affecting an existing claim will be communicated and will not retroactively reduce accrued consumer rights. If one provision is unenforceable, the remaining provisions continue. The English version controls until we publish an expressly designated translation.
